
Terms and Conditions Tone Leisure Limited January 2013.
Membership - If you sign this agreement, you will become a member of Tone Leisure and the centres covered by your chosen membership package overleaf. This agreement sets out the terms that will govern the relationship between us, your chosen facilities, and you, a member of Tone Leisure.
Membership Period - You agree to remain a member for the “Minimum Membership Period” that you have chosen. Your membership will automatically be extended once the minimum membership period has ended for consecutive one month periods unless a) this agreement has been terminated or b) either party has given one month’s prior written notice of its intention to cancel it.
Cooling Off Period - You have the right to cancel your membership within the first seven days of signing this agreement. Any facility use made during this period will be deducted from your refund at the current advertised casual rates.
Cancellation - Either party may cancel your membership by a) giving one month’s prior written notice before your direct debit payment date, one month before the end of the minimum membership period or b) by giving one month’s prior written notice before direct debit payment date at any time thereafter. You must provide such notice to the Membership Administration Team, Quayside Leisure Centre, Rope Walk, Kingsbridge, TQ7 1HH for South Hams members or The Administration Team, Tone Leisure, The Deane House, Belvedere Road, Taunton, Somerset TA1 1HE for Somerset members.
Suspension - In the event you become unwell and unable to make use of your membership Tone Leisure will consider freezing your membership for up to 6 months on receipt of a stamped doctor’s certificate or letter. All requests should be made in writing to the appropriate Membership Administration Team at the address above. (No. 4).
Joining Fee - There is currently a joining fee of up to £25.00 applicable to ONE Membership.
Payment - All Packages -The initial payment specified overleaf and all subsequent membership subscriptions must be paid in full, as and when they fall due, to Tone Leisure. Please note that additional charges may be made for services not covered by your chosen package e.g. Personal Training. ONE Annual – Tone Leisure will write to you at least one month prior to your renewal date advising you of the renewal subscription fees and the process you need to follow. ONE Annual DD – After the cooling off period you are committed to making 12 consecutive direct debit payments to Tone Leisure. If for whatever reason you are unable to make one of these payments we would ask that you discuss your circumstances with the Membership Administrator on 01548 802323. If you fail to make a payment as and when a monthly subscription falls due, Tone Leisure will write to you within 7 days requesting immediate payment of the overdue subscription plus a £5 administration charge. If payment is not made within a further 7 days your membership will be suspended until outstanding subscription fees are paid. ONE Monthly DD / Access to Leisure & Swim Easy – After the cooling off period you are committed to making regular monthly direct debit payments to Tone Leisure. For failure to make a payment please refer to ONE Annual DD above.
Access To Leisure Direct Debit - If you qualify for Tone’s Access to Leisure scheme, Tone Leisure require sight of your proof of eligibility every 6 months to maintain this membership status. Tone Leisure will write to you 6 weeks in advance of the six month anniversary requesting presentation of proof within 4 weeks. Failure to produce the documentation within this period will result in your membership reverting to the full ONE Monthly DD package at the six month anniversary.
Swim Easy - This easy payment monthly direct debit is for swimming lessons only. On-going monthly payments cover the full 50 week lesson programme delivered by Tone Leisure.
Termination - This agreement may be terminated at any time by either party if a condition of the agreement is breached as set out below. You may terminate this agreement at any time if we do not provide the facilities or the services you may reasonably expect and we have fallen well below that standard. We may terminate this agreement at any time if you treat the facilities, our members, or staff without the consideration we may reasonably expect. In cases of termination we reserve the right to recover any outstanding fees.
Booking Activities - Activity bookings can be made up to 8 days in advance on-line, by phone or in person. In the event you cannot make a pre-booked activity you are required to give a minimum of 2 hours notice by the same means for fitness classes, or 24 hours for any other activity. Crèche places cannot be cancelled once booking and payment is received. Failure to give adequate notice will result in a charge being levied at the full current activity rate.
Other - These terms and conditions are subject to change. Any changes will be advertised within Tone Leisure facilities, on Facebook, Twitter and on our website http://www.toneleisure.co.uk a minimum of 28 days in advance of that change. Membership fees and centre charges are subject to annual review normally in January. Again any change will be posted on Facebook, Twitter, our website and published in our facilities a minimum of 28 days in advance. Centre Opening Times are subject to change, but will be advertised with a minimum of 28 days notice on Facebook, Twitter, on our website and published in our facilities. Centre programmes are also subject to change based on customer demand, changes in trends and or unavoidable resourcing issues. All planned changes will be communicated to customers in the centre, on Facebook, Twitter and on-line with a minimum of 28 days notice.
Your Responsibilities - You must treat our members and staff with the consideration you would expect them to show to you. In particular, you must not make remarks which are rude or offensive or behave in a manner that is dishonest, indecent or aggressive.
Your Rights - We will be liable to compensate you if you suffer personal injury or die as a result of our negligence. We will compensate you if you suffer any other loss as a result of our failure to carry out our obligations under this agreement, provided that our failure did not occur as a result of your own fault, or our breach could not have been avoided even if those acting on our behalf had taken reasonable care. Nothing in these terms will affect your statutory rights. If you need further information about your statutory rights please contact your local Citizens Advice Bureau.
Data Protection - If you do not pay everything you owe Tone Leisure or you fail to make a payment as and when it falls due, Tone Leisure Limited may pass on your information about you to financial and other organisations. This may affect your credit rating. Subject to that exception, your personal details will not be disclosed to outside organisations and / or individuals without your written consent.�
