PreEmployment Checks

If offered employment, what checks will Tone Leisure undertake regarding my suitability and eligibility?

Any offer of employment is subject to your eligibility to work in UK, upon satisfactory receipt of two references, CRB and medical clearance and (if applicable) ISA registration. Upon acceptance of our offer of employment, you will be required to complete relevant paperwork relating to these checks, and will not be permitted to commence employment until clearance is issued by the HR team.

Am I eligible to work in the UK?

The following categories of people can take up any lawful employment in the UK and do not need a work permit:

Whose details can I provide as my "references"?

We ask for two references to be provided and these should be individuals who are able to comment on your suitability for the role from a professional and work performance perspective. This would obviously include your current and/or previous employers but may also include school or college tutors or individuals that you may have worked for in a voluntary capacity. Tone Leisure will not accept references from friends, peer work colleagues, family members or non work related professionals such as your Doctor or Vicar. If you are unsure please speak to the HR Team before submitting your application.

Will you automatically contact my current employer?

If you do not wish us to contact your current employer without your prior permission please indicate this on your application form.

When do you seek references?

References are sought at around the time of offer. This may be prior to verbal offers being given, especially if we have a number of suitable candidates and references help us to make final recruitment decisions, or may be after an offer of employment has been made. In this later case the offer of employment will be subject to suitable references being received. If you do not wish us to contact your current employer without your prior permission please indicate this on your application form

What is the ISA scheme (or my ISA registration number)?

The ISA Vetting and barring scheme is aimed at safeguarding both children and vulnerable adults in the workplace. Employees undertaking "regulated" activity have a legal obligation to register with the scheme. Employees undertaking "controlled" activity will have a legal obligation to register with the scheme from 2015. Tone Leisure will process your ISA application upon your behalf, at the same time as your CRB form is processed. Upon approved registration you will receive an ISA registration number, which needs to be provided to Tone Leisure before you commence working us. The registration provides lifelong membership and you can use it for all future posts within Tone Leisure, and for other employers too. If you have already undertaken the registration and can provide your ISA reference number, you will not be required to complete this process again.  From July 2010 onwards, further details, and any cost implications, will be communicated to successful applicants at the time of offer.

Tell me about the CRB (Criminal Records Bureau) process?

The Criminal Records Bureau (CRB) is a department of the Home Office responsible for provision of checks into the backgrounds of any individual applying for a position that may involve their working with individuals considered to be of a vulnerable disposition. A CRB check will indicate if you have been the subject of any criminal proceedings which may have resulted in a criminal record.

Tone Leisure provides services to all sectors of the community including children and vulnerable adults, it is therefore our company policy to request an enhanced CRB disclosure certificate for all employees and casual workers. In line with this policy a CRB check is completed for each employee prior to your commencement of employment, and every 3 years thereafter.

The Rehabilitation of Offenders Act 1974 gives individuals the right not to disclose details of old offences that are "spent", however as posts within Tone Leisure have either direct or indirect contact with children and/or vulnerable adults, under these circumstances the Rehabilitation of Offenders Act does not apply. Therefore you are required to provide details within you application of all current and spent convictions, cautions and bind-overs. In addition to declare if you are on the ISA Barred List (previously known as List 99, the PoCA List and PoVa List) or are disqualified from working with children and/or vulnerable adults or subject to sanctions imposed by a regulatory body. Please note that any information deemed relevant by the CRB is reported back to both Tone Leisure and you in the form of a CRB disclosure certificate. If upon carrying out such a check it comes to light that you have a criminal conviction that means you are a potential risk to those whom you will look after in the course of your job, your offer of employment will be reviewed, and if deemed necessary revoked. Of course Tone Leisure will communicate with personally during this decision making process to keep you informed. All applicants should also be aware that in certain posts you will not be able to commence duties until a CRB check has been carried out and cleared by the HR Team. The CRB process normally takes approximately 4 weeks to complete, but may take less/more time depending on the individual.

Tell me about the pre-employment medical questionnaire and process?

All applicants offered employment are required to undertake a medical questionnaire to self-certify your own physical and/or mental suitability to undertake the tasks and duties relevant to the post. The information supplied is confidential and will be shared only with the HR department, our Occupational Health provider and your line manager (if relevant). Based on the information supplied on your medical form, you may be referred to your GP or our local Occupational Health provider (NHS) with a view to assess your physical and/or mental suitable for the post. The assessment will advise us of any risks the proposed duties may pose to you, or your colleagues or our customers as a result of your health and/or condition. Any support needed by you to do the job effectively including any reasonable adjustments which will enable you to undertake duties effectively. Please note that in the interest of your health and safety, and that of your colleagues and our customers, you will not be permitted to commence employment until full medical clearance has been issued by the HR department. The timescales for this process will vary depending on the individual, however you will be kept fully informed of the situation.

What happens if satisfactory clearances are not received?

If for any reason Tone Leisure has cause for concern regarding your suitability for the role, for example upon receipt of your references, medical advice or a disclosure from the CRB, this will be discussed with you and the offer of employment may be withdrawn..

Can I commence work before pre-employment clearance is received?

You must not commence work until satisfactory references, ISA and medical clearance have been received. In the case of ISA it will be unlawful for this to happen.

If all other clearances have been received and we are still awaiting your CRB in some instances it may be appropriate for you to commence work, however you must be supervised at all times until CRB clearance has been received.
